Terms and Conditions

Orders for Goods in the HOLIES Online Shop

1 Scope and Contracting Party

These Terms and Conditions apply to the purchase of goods via holies-club.com. The contracting party is Mohammed Abbas, trading as HOLIES, Hermeskeiler Str. 24, 50935 Köln, Germany, telephone: 01520 480610, email: info@holies-club.com.

Orders may only be placed by persons aged 18 or over. A customer account is not required to place an order. The version of these Terms and Conditions that applies is the one incorporated when the order is placed.

2 Order and Conclusion of Contract

The presentation of the goods in the online shop does not yet constitute a binding offer to contract. Features, variants and prices are set out in the respective product description.

The ordering process comprises the following steps: (1) selecting the goods and adding them to the shopping cart; (2) entering the delivery and billing address and selecting the shipping method; (3) on the last page, an overview of the items, prices including shipping costs and address, selecting the payment method, accepting these terms and conditions and clicking the “Pay now” button; (4) followed by payment via Mollie. Before submitting your order with binding effect, you can check your details on the last page and correct input errors: the step indicator at the top of the page or the link back to the address takes you to the previous steps; you can also change the address and shipping method via the “Edit” link next to the address, and items and quantities in the shopping cart (change quantity, “Remove”), which you can reach via the cart icon. By clicking the “Pay now” button, you make a binding offer to purchase the selected goods.

We will confirm receipt of your order by email without undue delay. The contract is concluded with our order confirmation by email, which we send after successful payment via Mollie; the acknowledgement of receipt and the order confirmation may be combined in one email. If payment is cancelled or fails, no contract is concluded.

The contract language is German. We store the contract text (your order data and these terms and conditions) after the contract is concluded. You will receive it with the order confirmation by email; if you use a customer account, you can view your orders there. With the order confirmation you will receive by email the contract content, these terms and conditions, the withdrawal instructions with the model withdrawal form and the EU notice on the legal guarantee of conformity.

3 Prices and Payment

The prices displayed at the time of ordering apply. All prices are final prices and include statutory VAT. Outbound shipping within Germany is free of charge.

Payment is processed via Mollie. Card payment, Apple Pay, Google Pay and PayPal are available.

4 Delivery

We deliver only to delivery addresses in Germany. Delivery takes place within 2 to 4 working days after receipt of the order. The first day counted is the following working day. Working days are Monday to Saturday, excluding statutory public holidays.

Orders are delivered in full; partial deliveries are not made.

5 Right of Withdrawal

Consumers have a right of withdrawal where the statutory requirements are met. Details on withdrawal, returns and reimbursement, as well as the model withdrawal form, can be found in the separate withdrawal instructions. You can also exercise your right of withdrawal online via the “Withdraw from contract here” link in the footer of every page of our online shop.

In the case of an ordinary withdrawal, you bear the direct costs of returning the goods. Your statutory rights in the case of defective goods remain unaffected.

6 Retention of Title

The goods remain our property until they have been paid for in full.

7 Statutory Warranty Rights

The statutory warranty rights apply. You can find the legally required EU notice on the legal guarantee of conformity via the link “Your legal guarantee rights” in the footer of every page and on every product page. These Terms and Conditions do not restrict the statutory rights of consumers. An additional guarantee exists only if it is expressly promised.

8 Liability

We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and in cases of fraudulent concealment, an assumed guarantee, and under the German Product Liability Act (Produkthaftungsgesetz).

In the case of slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. Essential contractual obligations are obligations whose fulfilment is a prerequisite for the performance of the contract in the first place and on whose observance you may regularly rely. The cases mentioned in the preceding paragraph remain unaffected.

In all other respects, the statutory provisions apply.

9 Applicable Law

German law applies. In the case of consumers, mandatory protective provisions of the state in which they have their habitual residence remain unaffected.
